Customs officers shall have, pursuant to the provisions of Article 63b, a right of access to premises and places of business.
The implementation of this prerogative of control requires the prior information of the public prosecutor, who may oppose it.
This information formality is not subject to any particular formality.
As the Cour de cassation recently recalled, the report given to the operator indicating the prior information of the public prosecutor can demonstrate this information (Cass. crim., March 18, 2020, no. 19-81.001).
